PART I PRELIMINARY

Ordinance may be cited as the Trade Descriptions Ordinance.
nterpretation.
In this Ordinance, unless the context otherwise requires--

other history, including previous ownership or use;

a trade mark relating to goods registered in Hong Kong under the
Trade

a trade mark registered in the register of trade marks kept under

a trade mark--
registered, or in respect of which an application for

made, in a British territory or a Convention country; and

(a) For the purposes of this Ordinance, goods shall be deemed to
have

manufactured in the country in which they last underwent a

Notwithstanding the definition of "false trade description" in

Where an order under this section is in force with respect to goods

description, any person who, in the course of any trade or
business,
lies or offers to supply goods of that description in
contravention of
order commits an offence.
An order under this section may make different provision for
different
umstances and may, in the case of goods supplied in
circumstances
e the information or instruction required by the order would
not be
eyed until after delivery, required the whole or part thereof
to be
displayed near the goods.

PART II FALSE TRADE DESCRIPTIONS OR REPRESENTATIONS AND
FORGED TRADE MARKS

Subject to the provisions of this Ordinance, any person who--
forges any trade mark;
falsely applies to any goods any trade mark or any mark so

disposes of or has in his possession any die, block, machine or

commits an offence unless he proves that he acted without intent

Subject to the provisions of this Ordinance, any person who

国际铁路联运清算办法

第一章 总 则
第1条 国际铁路联运清算工作,是我国铁路运输收入和国家外汇收入的财务管理工作,同时也是我国铁路涉外工作的一部分。其任务是,正确办理国际铁路联运中一切费用的清算,及时处理国内外债权债务,保证我国铁路的正当收益,保证国家外汇收入的完整。
第2条 根据国际铁路合作组织统一制定的协定、细则及一切有效规章、国境铁路协定和议定书、国内铁路客货运输规章及运输收入管理规程和有关财务规定特制定本办法,做为国内有关单位办理国际铁路联运清算工作的依据。
第二章 国际铁路联运清算机构
第3条 机构的设置
铁道部国际联运清算中心(以下简称部清算中心),是我国铁路对内对外办理国际联运清算业务的全权机构。其国内直接发生业务关系的单位为:各铁路局财务处、各铁路分局收入检查室、办理国际联运客货运输业务的车站、列车(客运)段及列车、中国国际旅行社总社及各分(支)社。
第4条 职责范围
部清算中心的职责范围包括:
1、负责国际联运旅客票价、行李、包裹运送费用的审核和清算工作。
2、负责国际联运进口货物、出口货物和过境货物运送费用的审核和清算工作。
3、检查、监督国际联运货物国内段运送费用的收缴与清算工作。
4、负责国际联运车辆使用费、列车服务费、事故赔偿费等在国际联运业务中所发生的一切费用的清算工作。
5、负责国际旅客联运乘车票据的印刷、管理及国际货物联运运单印制的审查工作。
6、负责国际铁路联运清算业务的监督、检查与指导工作。
各铁路局、分局、国际联运客货营业站、列车(客运)段及列车、中国国际旅行社总社及各分(支)社,在办理国际铁路客货联运业务中发生的各项费用,要做到正确核收;款额及时上缴,各项报表准确无误、按时上报,以保证我国铁路对外清算工作的正常进行。
第三章 国际铁路联运旅客票价和费用的清算
第5条 一切国内外铁路和国际旅行社发售的、发到和过境中国铁路的国际联运客票和卧铺票与补加费收据,以及在国际列车中发生的费用,全部由部清算中心审核并负责同国外清算。
第6条 中国国际旅行社发售国际联运乘车票据票价的清算
1、中国国际旅行社各分、支社根据《清算规则》第2.1项有关规定,编制格式第1号表(或1—4号表)和第1—1号表,于清算月次月五日前报国际旅行社总社,总社于十五日以前寄部清算中心。
清算表(附外文)编制的份数(包括自留的一份)如下:
格式第1号表(或1—4号表):到朝、越、蒙的四份,经满洲里到苏联的四份,到波、捷、匈、罗的五份,到德、保的六份;经二连到苏联的五份,到波、捷、匈、罗的六份,到德、保的七份。
格式第1—1号表:指乘我路卧车的二份,指乘他路卧车的四份。
中国国际旅行社扣除客票票价的5%作为旅行社收益(手续费),其余客票票价和全部卧铺票票价于寄送报表的同时按正确款额缴部清算中心。
2、部清算中心收到中国国际旅行社总社寄来的清算表和票款后,对票、款、帐、表进行审核对照,并按每一国家铁路分别编制“中国国际旅行社发售客票、卧铺票票价报告总表”(附表1)二份,一份(附清算表)于月末以前寄有关国家铁路清算。
第7条 在中国境内外籍旅客乘坐国际联运车厢票价的清算
在中国境内外籍旅客乘坐外国车厢时,由各地国际旅行社使用国际客协册页客票和卧铺票(将“MC”符号划去),按国内2号票价表核收外汇券,并编制国内用格式第1号表(或1—4号表)和第1—1号表各二份,于清算月次月五日前报中国国际旅行社总社,总社于十五日前随报告表一起寄部清算中心,并将全部票款(外汇券)缴部清算中心。
第8条 在外国境内的国内旅客乘坐中国车厢票价的清算
在外国境内的国内旅客乘坐中国车厢时,列车员向旅客收回的乘车证(或卧铺票)由列车(客运)段每月一次报部清算中心,由部清算中心编制格式第1—1号表二份,统一向有关国家铁路清算。
列车员在国际列车上用补加费收据补收的各项费用,由列车(客运)段将补加费收据存根按月汇总,连同所收款额(结汇后的人民币)一并汇交部清算中心。
第9条 到达和过境旅客票价的清算
1、凡持有国外发售的我国内段联运卧铺票的旅客,在我国各联运站转车时,均需在当地中国国际旅行社分、支社办理签证,乘坐我国内列车车厢时,还须办理换票手续,由旅行社换发“卧车乘车证”,并将收回的卧铺票和乘车证存根于月末报中国国际旅行社总社转部清算中心。
2、对乘坐中国铁路卧车的联运旅客(包括中国铁路发送的旅客),列车员应填写国际客协办事细则第6条第1项规定的卧铺使用通知单(附表2),连同应收回的卧铺票,卧车乘车证、补加费收据和有关客运记录交列车(客运)段,每月一次报部清算中心。
对乘坐19次(包括从28次转来)/20次(包括转至27次列车苏联车厢、27/28次列车朝鲜车厢、23/24次、89/90次列车蒙古车厢,以及其他车次外国车厢的国际联运旅客,均由各该次列车的中国列车长编制卧铺使用通知单,并按上述办法上报。
3、部清算中心收到上述收回的票据和通知单后,负责同国外格式第1号表(或1—4号表)和第1—1号表进行审核对照。
在审核对照过程中,发现漏列客票和计算错误时,应在收到国外格式第1号表(或1—4号表)之日起的二个月内按《清算规则》的有关规定编制格式第1—3号表三份,寄往外国铁路二份签认。外国铁路签认的格式第1—3号表由部清算中心审核列帐。对漏列的卧铺票,由部清算中心编制格式第1—1号表二份,将其中的一份连同有关的卧铺票一并寄发售路(或指乘路)进行清算。
4、外国铁路提出的格式第1—3号表,由部清算中心在收到该表之日起的二个月内进行审核处理,并签复国外。
第10条 退还国际旅客联运票款的清算
1、根据《国际客协》第30条第9项的规定,旅客在乘车前向原购票的中国国际旅行社分、支社提出退票请求时:
(1)对当月售出的乘车票据,可立即办理退款,已退款的乘车票据按废票处理,并注明“退票”字样,随月报报部清算中心。
(2)对非当月售出的乘车票据,应根据下列情况,分别办理。
根据《国际客协办事细则》附件第1号第3条和《清算规则》第2.1.1.5项的规定,可单独决定满足退还票款要求时,可立即办理退款,并填写“扣除未使用客票和卧铺票票款清单”(附表3)二份,连同乘车票据寄部清算中心,部清算中心据此在给有关国家铁路报告总表中将退票款额扣除。
根据退票请求书陈述的情况判断可同意退款,但提供的乘车票据未按《国际客协》第30条规定办理时,则填写“退还客票和卧铺票票款明细表”(附表4)二份,另外,中铁以外的每一参加运送的铁路各一份,连同乘车票据寄部清算中心,经有关责任路同意后,再将票款退给旅客。
2、退还票款时,旅行社所扣除的客票票价5%的手续费不退。
3、部清算中心接到国外的退票请求书,应同该路寄来的格式第1号表(或1—4号表)和第1—1号表进行审核对照。如该项款额确已列入清算表,并根据《国际客协》第30、38条规定审核同意退款时,则签复国外,并将退票请求书和所附的乘车票据留下或随函转寄他路;不同意退款时,应填注理由,将退票请求书连同所附的乘车票据一并签复国外。
第四章 国际铁路联运旅客行李、包裹运送费用的清算
第11条 发送国际旅客行李、包裹运送费用的清算
1、中国铁路发送的国际联运行李、包裹运送费用,由发站所属铁路分局根据发站报来的行李、包裹票存根进行审核,按《清算规则》第2.2.1项有关规定编制格式第2号表(或2—1号表)三份,于清算月次月十五日以前寄部清算中心二份(每经过一个过境路增加一份),并将代收的过境国铁路运送费用汇至部清算中心。格式第2号表(或2—1号表)按行李、属于旅客的包裹和不属于旅客的包裹分别编制。
2、部清算中心按每个国家分别编制“中国铁路车站发送行李、包裹运送费用报告总表”(附表1)二份,其中一份附清算表于清算月次月末以前寄有关国家铁路清算。
第12条 到达和过境行李、包裹运送费用的清算
1、到达和过境我国的行李、包裹运送费用,由到达分局或过境中国的出口国境分局,将到达的行李、包裹运行报单或过境的行李、包裹运行报单影印件,于每月五日前报部清算中心。由部清算中心与外国铁路的格式第2号表(或2—1号表)进行审核对照。
2、部清算中心在审核对照中发现漏列或计算错误时,在收到国外格式第2号表(或2—1号表)之日起的二个月内,按《清算规则》的有关规定编制格式第3号表三份,寄有关国家铁路二份签认。国外签回的格式第3号表,由部清算中心审核列帐。
3、外国铁路提出的格式第3号表,由部清算中心审核处理,并在收到之日起的二个月内签复国外。
第13条 发站核收的国际联运行李、包裹运送费用,应按规定及时上缴。对于少收、漏收运送费用,由部清算中心填发“国际铁路联运运送费用订正通知书”(附表7),寄发送分局处理,补收的款额于每月十五日前汇至部清算中心。
第五章 国际铁路联运进口货物运送费用的清算
第14条 为了正确办理国际联运进口货物运送费用的清算,特制定“国际联运进口货物运送费用计算单”(简称“计算单”,附表5)。
计算单按运输收入票据管理,由进口国境站编制,由国境分局负责印制,带有固定号码,自00001~10000号循环。电子计算机作业时,由国境站自行编号打印,自年初起至年终止顺序编号。
计算单一式四联,使用方法如下:
甲联,贴在运单第二联上随同所运货物交到站;
乙联,于清算月份的次月五日前汇总报部清算中心;
丙联,于清算月份的次月五日前汇总报所属国境铁路分局收入检查室;
丁联,进口国境站存查。
第15条 进口国境站对进口货物运送票据要按规定进行核对,对过境路在运单上记载的应向收货人核收的运送费用进行复核,按《统一货价》正确计算,并根据国内《价规》计算应向收货人核收的国内段运杂费后,逐批编制计算单,同时,在运单第2张“向收货人计算的费用”栏下
空白处加盖“附计算单第……号”戳记。
第16条 到站对运单上贴附的计算单进行复核,发现内容和项目填写不全或运送费用计算错误时,应更正计算单,按正确款额以运费杂费收据核收,并按规定上缴进款。运单第2、4张及计算单随运杂费收据上报所属分局收入检查室。
如进口货物入境后中途变更到站,应由受理变更的车站发电通知进口国境铁路分局和原到站所属铁路分局收入检查室以及部清算中心,对到站变更的货物,由到站发电通知进口国境铁路分局收入检查室和部清算中心。如变更站未按规定发电通知,则清算的款额由变更站负担。
第17条 到达分局收入检查室对到站上报的运单、计算单和运费杂费收据,要按规定进行审核,并按进口国境站别编制国内4号表(附表6)。
对通过过境铁路的进口货物,根据计算单编制国内4号表一式三份(过境铁路运送费用由发货人承担时,在4号表“代收外国铁路运送费用”栏填记“发货人负担”字样),一份留存,一份在清算月份次月十五日前报部清算中心,同时,将代收的外国铁路运送费用汇给部清算中心,一
份在清算月份次月十五日前寄给进口国境铁路分局,并将应付的运杂费汇给国境铁路分局收入检查室。
对邻国铁路进口的国际联运货物(不发生过境铁路运送费用),根据计算单编制国内4号表一式二份,一份留存,一份在清算月份次月十五日以前寄给国境铁路分局收入检查室,同时,将应付的运杂费汇给国境铁路分局收入检查室。
应付国境铁路分局的进口货物运杂费,包括:进口货物国内段运费的50%;在国境站发生的换装费、加固费、滞留费、货物暂存费,以及其他杂费和罚款。
第18条 部清算中心收到进口国境站上报的计算单后,将其中有代收过境铁路运送费用的计算单与国外4号表(或4—1号表)对照审核,并按到达分局别分类,用以与到达分局提报的国内4号表进行对照审核。
第19条 部清算中心在对照审核中,发现国外4号表(或4—1号表)与国内4号表所列款额不符,发生多收、少收、漏收时,按下列办法处理:
国外4号表(或4—1号表)正确,国内4号表少收或漏收时,填发“国际联运运送费用订正通知书”(附表7),寄到达分局,由到达分局补收后于每月十五日前将款汇给部清算中心,并签返订正通知书。
国内4号表正确,国外4号表多收时,由部清算中心向外国铁路提出重新计算表办理重新清算。
国内4号表和国外4号表(或4—1号表)均多收时,由部清算中心向国外铁路提出重新计算表,经签认列入结算表后,填发“国际联运运送费用订正通知书”,连同应退款汇给到达分局办理退款。
第六章 国际铁路联运出口货物运送费用的清算
第20条 出口货物运送费用的清算,是指我国铁路发送、由发货人负担过境铁路运送费用的清算。
第21条 发送国际联运货物的车站,向发货人核收的过境铁路(包括绕路朝鲜铁路)运送费用,应按《统一货价》的规定正确核收,及时上缴,并按规定将带号码的补充运行报单上报所属分局收入检查室。
第22条 发送分局对发站报来的带号码的补充运行报单按规定审核列帐后,对代收的过境铁路运送费用,按出口国境站别编制国内4号表一式二份,一份留存,一份于清算月次月十五日前报部清算中心,同时,将款汇给部清算中心。
第23条 部清算中心收到国外4号表(或4—1号表)和国内4号表后,要进行对照审核,发现多收、少收或漏收过境铁路运送费用时,按本办法第19条规定处理。
第24条 货物到达出口国境站时,出口国境站应对带号码的补充运行报单与运单中所记载的运送费用进行核对检查。如费用记载相符,上述运行报单留存该站(保存一年)。如不符,应在带号码的补充运行报单第91“有关计费记载”栏内作出相应记载,并将其寄给发送分局收入检
查室处理。如发现缺少带号码的补充运行报单,应将不带号码的补充运行报单复制一份,并在91栏作相应记载后,寄给发送分局收入检查室处理。
第25条 出口国境站在复核检查过程中,发现品名和重量不符,应向发货人补收的运送费用,以及在国境站发生的车辆滞留费、货物暂存费等其他杂费应向发货人补收时,填发“应向发货人补收费用通知书”(附表8)一式四份。一份寄给发站,二份报所属分局收入检查室转寄给发
送分局收入检查室一份,一份留存。
发站接到应向发货人补收费用通知书后,应及时向发货人补收并报缴进款。发送分局对这项补收款列入应付国境分局费用清算表内,并记明通知书号码,同时将款汇给国境分局。
第七章 国际铁路联运过境货物运送费用的清算
第26条 国际联运货物过境中国铁路所发生的运送费用,由我国铁路出口国境站负责按《统一货价》的规定,正确计算后记入运单有关栏(到达朝鲜的货物应向收货人核收的过境中国铁路的运送费用,还应记入货物交接单有关栏内)。过境货物由于发货人原因在过境中国铁路途中和
国境站发生的费用,应记入运送票据内。对于补送货物,应记入补送运行报单中。
出口国境站将截留的补充运行报单连同货物交接单于每旬(或月)末前报部清算中心,以便向发送路或到达路进行清算。
第27条 部清算中心对出口国境站报来的补充运行报单及出口货物交接单进行审核后,按下列规定办理:
到达东欧各国、苏联、蒙古、越南向收货人核收和各国发送向发货人核收的过境中国铁路货物运送费用,以及朝鲜发送绕路中国铁路的货物运送费用编制《清算规则》规定的格式第4号表(或4—1号表),按规定日期直接向有关国家铁路清算。
到达朝鲜向收货人核收的过境中国铁路货物运送费用,编制格式第15号表直接同朝鲜铁路清算(中朝铁路间的货物交接,仍使用一九七二年七月一日以前实行的国际货协办事细则附件第3号的货物交接单,过境运送费用的清算,仍根据一九六0年一月一日以前实行的《清算规则》格
式第15号总表办理)。
第28条 通过中国港口站出口和绕路中国铁路运输的国际联运货物(不包括国际标准集装箱货物),过境中国铁路运送费用必须由发货人承担。港口站将截留的补充运行报单于清算月次月五日前寄部清算中心。
第29条 外国铁路向我路提出的过境货物运送费用重新计算表,统一由部清算中心按《清算规则》的规定办理。
第八章 国际铁路联运车辆使用费和集装箱滞留费的清算
第30条 行李车使用费的清算
1、中国铁路和外国铁路相互使用行李车,由国境站编制《清算规则》规定的格式第6号表报国境铁路局。
2、外国铁路使用中国铁路行李车的使用费,由外国铁路提出格式第6号表,有关国境铁路局接到后应根据国境站报来的格式第6号表进行对照,并于次年初编制《清算规则》的格式第7号表寄给有关行李车使用路。公函抄件寄《清算规则》中规定的外国铁路清算机关和部清算中心,
以便各路间进行清算。
3、中国铁路使用外国铁路行李车的使用费,由国境铁路局根据国境站报来的格式第6号表,寄给行李车所属路国境铁路局,公函抄件寄外国铁路清算机关。国境局接到外国铁路提出的《清算规则》格式第7号表时,应在规定期间内与格式第6号表进行核对。部清算中心根据外国铁路
寄给我国境局的格式第7号表的公函抄件进行清算。
第31条 货车使用费的清算
1、中国铁路货车在国外的停留期间,由国境铁路局根据外国铁路提出的《清算规则》格式第8、9号表同国境站报来的车辆交接单进行核对。发现错误时,应在二个月内向车辆使用路提出《清算规则》规定的格式第10号表二份。部清算中心根据外国铁路提出的格式第8、9号表的
公函抄件和签认帐单的公函抄件进行清算。
2、外国铁路货车在我国铁路上停留期间,应由国境铁路局或国境站根据车辆交接单编制格式第8、9号表二份,于清算月份后二十五日前寄给车辆所属路一份,公函抄件报部清算中心进行清算。外国铁路提出的格式第10号表由国境局负责在二个月内进行审核,并将签认的公函抄件
报部清算中心进行清算。
3、通过中国铁路移交给越南、苏联铁路的朝鲜货车,由柳州、哈尔滨铁路局在次月十日前用格式第8号表(或以车辆交接单代用)将交出和接入日期、交接单号、车辆号码通知沈阳铁路局。朝鲜货车在中国铁路往返两段停留时间分别计算使用费。
4、中苏间货车使用费的清算,按《中苏国境铁路联合委员会会议议定书》办理。
第32条 集装箱滞留费的清算
集装箱滞留费的清算,应以格式第8号和9号表办理,部清算中心根据外国铁路或国境铁路局寄送帐单的公函抄件进行清算。
第九章 国际铁路联运其他费用的清算
第33条 货物换装费、加固费和货车装备费、更换轮对费的清算
1.国境站代替外国铁路进行作业所发生的货物换装费、加固费和货车装备费、更换轮对费,均按《清算规则》的规定编制格式第11号表。各国境铁路局审核后于次月末以前,将应清算的款额函报部清算中心进行清算。
2.国境铁路局在审核过程中发现错误时,应通知国境站在次月进行调整。中越、中蒙之间应按中越、中蒙国境铁路联合委员会议定书的规定进行调整。
第34条 行李和包裹换装费、货物倒装费和包装补修费的清算
1、发往越南的行李、包裹,在凭祥站用中国铁路人工器材代替越南铁路换装而发生的费用,由越南铁路承担。由凭祥站编制《清算规则》格式第11号表,该所属分局审核后将公函抄件寄部清算中心进行清算。
2、根据国境铁路联合委员会议定书的规定,接收路根据交付路的请求进行货物倒装和包装修补时,所发生的费用按国内规定的价格计算,由国境站编制格式第11号表,所属分局审核后将公函抄件报部清算中心进行清算。
第35条 客车更换轮对费的清算
1、在中国铁路上办理更换轮对时,按《车辆使用规则》规定费率计算的费用由参加运送的各有关国家铁路按运行里程比例分摊。国境铁路局根据国境站报来的各车交接单(或格式第6号表)编制《清算规则》规定的格式第15号表,向有关国家铁路提出,公函抄件报部清算中心进行
清算。
2、国境铁路局收到在苏联铁路上办理客车更换轮对的格式第15号表时,应按《清算规则》的有关规定,同车辆交接单核对,部清算中心根据苏铁寄给国境局的公函抄件进行清算。
第36条 交接列车服务费的清算
1、国境站应于清算月次月五日以前根据车辆交接单将交接列车完成的车轴公里按《清算规则》有关规定编制格式第14号表报国境铁路局,国境铁路局将格式第14号表同车辆交接单进行审核对照后,按各有关国境铁路协定中规定的费率计算交接列车服务费,并将应清算的款额函报
部清算中心进行清算。
2、中苏间交接列车服务费的清算,按中苏国境铁路联合委员会议定书办理,并将函件抄报部清算中心进行清算。
3、中朝、中蒙间的交接列车服务费互不清算。
4、国境铁路局在审核过程中发现错误时,应通知国境站,由国境站编制补充帐单,经双方签认后报国境局,国境局审核后函报部清算中心进行清算。
第37条 一方铁路工作人员在对方国境站支款的清算
1、苏联铁路工作人员在满洲里、绥芬河站借支人民币和中国铁路工作人员在后贝加尔、格罗迭科沃站借支卢布时,应根据铁道部一九五五年六月十一日联清(55)字第4234号函规定的手续办理清算。
2、苏联和蒙古铁路工作人员在二连站借支人民币时,应根据铁道部一九五五年十二月二十二日联清(55)字第4691号函和一九五六年三月十日联清(56)字第4172号函规定的手续办理清算。
3、对于中国铁路工作人员在国外的借支款,各有关国境铁路局和车站应严格掌握,除规定的交接人员可按规定标准借支外,其他人员不得在国外借支。
第38条 卧车列车员在国境站上交款的清算
1、中国铁路卧车列车员在外国铁路出口国境站交付现款时,须提出《国际客协办事细则》第9号收据二份,经收款站签收后收回一份,由列车(客运)段按月报部清算中心。部清算中心根据国外的交款报告表(《国际客协办事细则》附件第10号)审核后,对外进行清算。
2、外国铁路卧车列车员在中铁出口国境站交付现款时,收款人员应根据外车铁路卧车列车员提出的《国际客协办事细则》附件第9号收据记载的款额进行核对签收后,将一份收据签字盖章退还交款列车员,另一份报国境铁路局。国境铁路局审核后编制《国际客协办事细则》附件第1
0号报告表,函送有关国家铁路清算机关,抄件报部清算中心对外清算。
苏联卧车列车员在丹东站交付现款时,交款收据由丹东分局审核后汇总,抄报部清算中心对外清算。
第39条 赔偿费的清算
1、关于行李、包裹和货物的灭失、毁损,以及运到逾期的赔偿请求,应按《国际客协办事细则》附件第1号、《国际货协办事细则》附件第1号和《国际铁路货物联运办法》第33、34、35条规定的办法由有关国境局负责处理。外国铁路提出的赔偿请求,如我国铁路承认赔偿全
部或一部分时,国境铁路局给国外的复函须抄部清算中心和责任局;我国铁路提出的赔偿请求,国外承认时,国境局将国外的签认函抄部清算中心和处理局,由部清算中心同国外和有关铁路局进行清算。
2、货车灭失或遭受严重破坏而报废时,根据《车辆使用规则》第19条规定的办法办理。
货车赔偿费按铁路合作组织有关会议议定书规定的价格(无规定的按国内价格)计算。双方商定的函(电)抄部清算中心,以便对外清算。
第40条 货车修理费的清算
1、中国铁路货车在国外由于外国铁路责任而发生毁损返回中国铁路修理时,应由国境站车辆技术交接人员根据《车辆使用规则》和《国境铁路协定》的规定编制车辆不良记录,经双方签认后报国境铁路局,所发生的费用由国境局按《车辆使用规则》核算后,编制《清算规则》规定的
格式第16号帐单,并函寄车辆损坏的责任路。部清算中心根据国外签回帐单的公函抄件进行清算。
2、外国铁路车辆在中国境内由于中国铁路责任而发生毁损返回车辆所属路修理时,外国铁路提出的格式第16号帐单,由国境铁路局负责根据国境站报来的车辆不良记录进行审核,向国外签认的公函抄件报部清算中心进行清算。
第41条 货车洗刷清毒费、调车费、检衡车使用费、救援列车(包括除雪车)作用费、运送用具修理费以及国境站为另一方所完成的一切其他劳务和工作方面的费用,均按《清算规则》有关规定以格式第16号帐单办理清算。
机车、集装箱、运送用具和运输上其他技术装备的灭失、毁损的赔偿、修理费,以及篷布滞留费用,也都以格式第16号帐单办理清算。
以上各项费用的提赔函和外国铁路签认函的抄件,均需报部清算中心,以便对外清算。
第42条 本办法未列的有关清算项目,均按《清算规则》的规定办理。函件和外国铁路签认函的抄件均需报部清算中心,以便对外清算。
第十章 财务列帐与结算
第43条 国际铁路联运清算业务适用于铁路运输收入会计管理方式。
第44条 财务列帐的依据:
1、应向国际旅行社核收的国际联运旅客票款,由部清算中心凭国际旅行社的交款通知单列帐。
2、应向外国铁路核收和应付外国铁路的国际联运旅客票价和费用,由部清算中心按格式第1号表(或1—4号表)和格式第1—1号表以及签认的格式第1—3号表和退票请求书列帐。
3、应向外国铁路核收和应付外国铁路的国际联运行李、包裹的运送费用,由部清算中心根据格式第2号表(或2—1号表)以及签认的格式第3号表列帐。
各铁路分局代收外国铁路的行李、包裹运送费用,根据格式第2号表列帐。
4、应收外国铁路的过境中国铁路货物运送费用,由部清算中心根据提出的格式第4号表(或4—1号表)列帐。
5、应付外国铁路的过境货物运送费用:
出口货物由部清算中心根据国外和国内4号表列帐,发送分局根据国内4号表列帐;
进口货物由部清算中心根据国外和国内4号表列帐,到达分局根据国内4号表列帐。
6、两邻国直接编送清算报表的应收、应付外国铁路的其他各项费用,由部清算中心和编制报表的国境铁路局(分局)根据有关的清算单据和函件分别列帐。
7、进口货物国内段运送费用由到达分局和国境铁路分局分别根据国内4号表和计算单列帐。
第45条 其他一切应收、应付外国铁路在国际联运过程中发生的各项费用,由部清算中心和有关铁路局根据国内和国外清算函件或报表单据分别列帐。
第46条 会计科目的设置
国际铁路联运清算的会计科目适用于《铁路运输收入会计规则》中规定的会计科目。
部清算中心的专用会计科目名称为:
1、应付外国铁路运杂费;
2、应收外国铁路运杂费。
铁路局、分局的科目名称为:
1、应付国际联运运杂费;
2、应收国际联运运杂费;
3、应付国境分局运杂费;
4、应收国境分局运杂费。
第47条 结算
国际铁路联运清算中的一切应收、应付外国铁路运杂费,统一由部清算中心通过银行汇款的方式与国内各有关铁路局、分局、国际旅行社进行结算(铁道部国际联运清算中心开户行:中国工商银行北京分行营业部,帐号057010—01)。
1、国际旅行社代收的国际联运旅客票价款,由中国国际旅行社总社将款汇至部清算中心帐户。
2、发、到站代收的行李、包裹运杂费、过境货物运送费用,由其主管分局将款汇至部清算中心。
3、应收应付外国铁路的事故赔偿费、运到逾期罚款,由部清算中心根据国境局和国外的签认函,直接同各有关处理局和责任局汇款结算。
4、国境站发生的应付外国铁路的费用,由所属国境铁路局(分局)将款汇至部清算中心帐户;应收外国铁路的费用,由部清算中心将款汇给国境铁路局(分局)。
5、为确保帐款相符,部清算中心和各铁路局、分局间的往来,均按不经签认手续,在规定时间内及时汇给债权方。如发现原帐单和报表有误,需提出订正,待对方签认后,将款退回,不许坐扣或部分支付。
6、对逾期不汇的款额,由债务方支付1%的迟交金,对订正通知书从发出之日起三个月内不予签复,则由债务方支付应付款额60%的迟交金。
第48条 对外清算
一切应收、应付外国铁路的运送费用,统一由部清算中心根据有关报表和函件,按月编制各国的定期结算表,并按《清算规则》的规定办理对外清算业务。
第十一章 监督与检查
第49条 国际铁路联运清算工作具体业务复杂,时间要求紧,经济责任重大。为了保证及时正确清算,必须加强监督、检查和指导工作。部清算中心工作人员凭“铁路运输收入稽查证”对各铁路局、分局、国际旅行社总社及各分、支社、国际联运客货营业站、列车(客运)段及列车
的国际联运清算业务进行检查,总结成绩,推广经验,发现问题及时纠正和处理,以维护我国铁路的正当收益。
第十二章 附 则
第50条 本办法自一九九一年一月一日起施行。(77)铁外字815号文公布的《国际铁路联运清算补充规定》及财收〔1986〕131号文《关于国际联运货物运杂费铁路内部清算办法的通知》同时废止。
第51条 本办法由部财务司负责解释。
